Material on our sites is mostly provided by Accommodation Gateway ABN
62 298 895 865 trading as Accommodation Gateway. and employees
(us, we, our).
We are simply a marketing and referral forum for short term holiday
lets less than 60 days.
Register your accommodation property, with Accommodation Gateway travel
portal on a commission only basis, that is, no confirmed reservation
or booking, no fee.
Accommodation Gateway Welcomes, travel
and holiday accommodation types covering Apartments, Private Holiday
Homes, Country Homes, Bed and Breakfasts, Resorts, Holiday Apartments,
Luxury Homes, Self Contained Accommodation, Hotels and Motels in Australia
in the regions of New South Wales, Queensland, Victoria, Northern Territory,
Western Australia, ACT and Tasmania .
Accommodation Gateway reserves the right to change these conditions
at any time and then posting them on this site.
Your establishment may be independent or chain, first class or budget,
large or small. Use our system on the Web to increase exposure, revenue
and room occupancy. Accommodation Gateway will make your business
information, including room descriptions, facilities, photos,
maps, rates accessible to the finger tip of any traveler worldwide.
Commission only model for refferal and marketing.
There is no sign-up cost to join Accommodation Gateway for displaying
Holiday accommodation. We offer our service on a no reservation
or confirmed booking, no fee basis. Holiday accommodation property partners
only pay a fixed Marketing Fee based on total booking cost. We charge
you 10% for our marketing fee.
Guests pay directly to Holiday Properties
Accommodation Gateway does not charge a reservation fee or pre-payment
from the guest. Only in some cases where the property owner has asked
us to take marketing a fee from their initial deposit being never more
than 10% of total booking cost.
Marketing worldwide
Accommodation Gateway helps you achieve global online marketing without
making any investments.
You are not charged upfront for listing.
Other benefits include receiving advertising by listing your property
on our site.
When You List "
All Properties receive their own dedicated webpage with photos and text.
" You can login and edit your listing details "
All enquiries/requests are sent directly to you “You will get
free use of the booking system and calendar".
Features and options are: availability calendar
( optionial),View reservations, affiliate program option, travel agent
management, care
taker management, last minute special, customer feed back forms, invoicing,
promotional coupons, generate brochures, generate virtual tours and
more.Virtual Tour of properties will be introduced shortly.
A property owner as defined, may not actually be the registered proprietor
of the property - they may be a manager or agent - please see
the definition of owner.
You are not charged for an inquiry. We send you an email after
the person has made a booking enquiry to see if they are confirmed and
then again after the departure date to confirm our referral commission.
We then send you the bill for payment which will be due within
7 days after check out.
We work on an honesty policy. By accepting our terms and conditions
you agree to pay us for bookings made initially through our website
http://www.accommodationgateway.com.au from our marketing of
your property.
We make some verification checks and when a complaint is made
about a property we try to verify that complaint and if proven to our
satisfaction we remove the advertising material or keep it depending
on the outcome.
Accuracy of information and disclaimer of warranties
Renters, Guests, Users and Owners
You agree not to claim against us for the failure of a booking, for
whatever reason. Accommodation gateway provides the infomation in good
faith.
If you are intending to stay at one of the properties described on
our sites, you must rely entirely in your own enquiries and satisfy
yourself as to the accuracy of the material on our sites.
Whilst we may provide the initial means of contact between you,
and the property we take no responsibility whatsoever for any transaction
entered into between you and the owner.
We cannot promise that
1. The person administering a property is the owner or registered
proprietor of that property.
2. That they have appropriate safety standards or insurance coverage.
The prices are fixed by the owner, we have absolutely no involvement
in determining the:
1. Price, value, suitability or of the safety for you or those
accompanying you on any stay.
In return for your access to material on our site you agree not
to make any claim against us.
You agree to leave the property in a condition similar to that in which
you found it and to report all damage and loss to the owner.
Reliance and Waiver
We will not accept any claim, by you in relying on any material contained
in, or omitted from our sites, whether due to our negligence,
or the negligence or even dishonesty of renters or owners or
advertisers. In return for access to or the publication of material
on our site you agree not to make any claim against us

We treat the personal information of users of our site with respect
and confidentiality and take all reasonable steps to ensure that
your personal information is stored securely and accurately.
If at any stage you have information we have stored that you
wish to change please let us know and we will not only amend.
By submitting your material on our sites, either as a renter or
an owner you agree, you ask us to email and/or SMS your personal information
to the owner or renter, as the case may be. Your personal information
which we collect and retain may also be used, by us, to promote
or inform you of our other products or services, which may interest
you.
You may notify us at any time that you no longer wish to receive
marketing or promotional material by emailing office@accommodationgateway.com.au
with REMOVE written in the subject line, and you will be removed
from any e-mail lists.
Your personal information will never be provided to any other
party for their use.Except in the case when you are making a booking
and your infomation is passed to the property.
Acceptable use:
Your use of our sites a condition of your use of our sites is
that you promise not to use our sites for any purpose that is unlawful
or prohibited by these terms and conditions or by other applicable
laws or regulations.
You agree:
1. You will not include false or misleading material on our sites,
or material that might be false or misleading
2. You agree to indemnify us for any claim, direct or indirect,
on a complete indemnity basis including our legal costs, whether
contributed to by our own negligence or otherwise that arises
from any breach of copyright or intellectual property rights
on material uploaded us on your behalf .
3. You agree to allow us to advertise your property worldwide.

We reserve the right to edit or remove any material on our sites
at any time at our absolute discretion.

The links on our sites to other sites operated by other parties are
not under our control. Following a link to other sites is done
at your own risk. Any advertising appearing on those sites is
not an endorsement by us.
Copyright
Copyright is claimed by us to the extent we are able to claim for all
material on our sites. Other than using it for your own personal
use, that material may not otherwise be used or copied without
our prior written approval or the prior written approval of the
person or corporation who owns it, a copy which approval you
will provide to us if we request it.
By placing advertising material on our sites you give us a license to
use that material, including altering it in any way, allowing
us to use it as we see fit in any media anywhere in the world
for the promotion of or information about our sites or business
or software, and you will not make a claim against us for breach
of copyright or intellectual property in that material
Governing Laws
The laws of the state of New South Wales, Australia, govern these terms
and conditions. You as a renter or owner, regardless of the situation
of the property, or where you are located, agree to submit to
the jurisdiction of the courts of New South Wales.
Owners
You agree to use this site only for advertising short term lets (less
than 60 days per stay). You agree that in return for the services specified
on our site and in e-mails sent to you, you will pay the amounts
specified for those services within 7 days of the invoice being forwarded
to you and that if you do not pay that invoice your material
may be removed from publication and we may commence proceedings
against you for any money you owe us at our discretion.
You agree not to claim against us for the failure of a booking, for
whatever reason.
We take reasonable care to transcribe your material into an online
format. However, we reserve the right to edit or condense material
in any way we see fit and you agree not to claim against us for
any change we make. In consideration of the publication of material
you supply to us you agree not to make any claim against us including
anything caused by our negligence. We reserve the right to refuse
any material based completely on our own discretion.
In renting out your property you must rely entirely on your own enquiries
and satisfy yourself as to the accuracy of the material sent
to you by our site or appearing on our site, Whilst we may provide
the initial means of contact between you, and the renter we take
no responsibility whatsoever for any transaction entered into
between you and the renter. You agree to make no claim for:
1. The conduct or behavior of renters,
2. Anything from a failed booking
3. The non-payment of a tariff or rent
4. The state in which the property is left, or
5. Damage which may be done to the property or neighbors
6. The loss of any data or records stored by us.
In consideration for the publication of your material on our
site you agree not to make any claim against us.
By placing material on our sites you give us a license to use that material,

You agree to provide material that is truthful about the property, that
is quiet, clean and safe to use as a rental property and that
you have appropriate insurance cover for your own losses and
claims that might be made against you by renters their guests
and your neighbors. Where renters do not have exclusive use of
the property or facilities this should be clearly explained.

Definitions
Negligence: wherever used includes our negligence as well as the
deliberate or negligent acts of others
Sites: means all websites, Internet access portals, URL's capable
of being accessed by a browser, including WAP and other formats operated
and maintained by you
Owner(s): the person or company who represents themselves to us
as the registered proprietors, agent, or administrator of the property
Stay: means the period of the rental of the property, to be less
than 60 days per stay.
Material: means Text, graphics, photos, other media and or any
information on our sites
Us, we, our: means Accommodation Gatewayl ABN 62 298 895 865 trading
as Accommodation Gateway and employees
Truth: Means reliability, accuracy or completeness
Claim: means a demand for payment, or rectification, or publication
whether by litigation or otherwise and includes the loss or damage
claimed and legal costs incurred
Promise: means a guarantee, warranty or representation
Renter(s): means person seeking to enquire about or stay at properties
referred to in material on our sites
Advertiser (s): means person advertising property for rent or for sale
User Agreement
The information presented by this site is deemed to be accurate, but
it has not been independently verified. We make no guarantee,
warranty or representation. It is the user's responsibility to
independently confirm accuracy and completeness.
User Conduct
User agrees to abide by all applicable local, state, national and foreign
laws, treatises and regulations in connection with the service.
The user agrees to not transmit or post information that is harmful
to other members.
Termination
This website in its sole discretion may terminate user's password, account
or use of the service and remove and discard any data within
the service if user fails to comply with this Agreement. User
may terminate the service upon notice to this website at any
time; however, user will not receive a refund of any portion
of fees paid. Upon termination, user's rights to use the service, web
solutions, domain name, design and associate technologies will
also terminate.
Indemnification
User shall indemnify and hold Accommodation Gateway and its parents,
subsidiaries, affiliates, officers, directors, employees, attorneys,
and agents, harmless from and against any and all claims, costs,
damages, losses, liabilities, and expenses (including attorneys'
fees and costs) arising out of, or in connection with user's
use of the service (including the content) or breach of this Agreement.
Limitation of Liability
In no event shall this website aggregate liability exceed the
amount actually paid by user in the twelve (12) month period
immediately preceding the event giving rise to such a claim.
In no event shall
Accommodation Gateway be liable to anyone for any indirect, punitive,
special, exemplary, incidental, consequential or other damages
of any type or kind arising out of, or in any way connected with
this service, including but not limited to user's use or inability
to use the service or for any content obtained from or through
the service, even if Accommodation Gateway has Listing Terms for
Holiday Property’s listings for users and people listing.
Your personal data will never be sold, traded, rented, exchanged
or given to anyone else without your consent. AccommodationGateway.com.au
will only use your personal membership information in accordance
with our privacy statement.
AccommodationGateway.com.au is an advertising and marketing facility
to assist property owners wishing to sell their own holiday property
(the "Facility"). By using AccommodationGateway.com.au advertising
you acknowledge and agree that AccommodationGateway.com.au :

You may advertise properties for sale only if you have legal rights
as the owner of the property.

Your personal data will never be sold, traded, rented, exchanged
or given to anyone else without your consent. AccommodationGateway.com.au
will only use your personal membership information in accordance

AccommodationGateway.com.au is an advertising and marketing facility
to assist property owners wishing to sell their own holiday property
(the "Facility"). By using AccommodationGateway.com.au advertising
you acknowledge and agree that AccommodationGateway.com.au :
Does not endorse any of the properties that are displayed through the
Facility;
1. By clicking on any link within this site you agree to the Terms
of Service. All aspects of AccommodationGateway.com.au are available
to persons acting as either private sellers or as property seekers.
Real Estate Agents or Marketeers for any businesses, unless not
acting in such capacity and acting specifically for the purpose
that they are genuinely interested in purchasing the property,
are not entitled to use this site to solicit business from listings
in The Facility. All users of

modify your listing, without notice, if we consider that the details
that you provide are incorrect, duplicated elsewhere on the site,
misleading or do not meet our standards;

or legality of the items listed or the truth or accuracy of the listings
and/or other item descriptions on the Facility;
11. AccommodationGateway.com.au listers are required to have a
current and valid email address to use the Facility;
12. you agree not to sell, resell, duplicate or use for any commercial
ends any aspect of the Facility.
13. We provide no money back guarantee for advertisements that you
place on our site.
14. We cannot guarantee the quality of your advertisement or the interest
that it will generate, as the quality of information provided is dependant
upon the user.
15. You will provide only true and correct information on this site,
and not endeavor to deceive any party who may use this site. If it is
thought by us that you have provided false information we reserve the
right to cancel your membership and remove you advertisement.

Credit card details
It is the policy of accommodationgateway.com.au to not store
any of our customer's credit card numbers. This means that even in the
unlikely event of our security becoming breached, there is nothing
to steal, and your credit card details remain safe, as we do
not take credit card details ourselves. This is handeled by the
property owners and or online payment processing accounts held with
online payment processing businesses. If there is an error processing
your card for any reason, (e.g. the card number you supplied
is invalid) transaction will be revoked. Although we do not store
your credit card details, all credit card transactions receive
a unique identification number that proves the transaction's acceptance
into the banking system. This identification number can be used
to trace any transaction back to the credit card issuer (eg;
the bank that issued the MasterCard, Bankcard, or VISA credit
card).
We are simply a marketing forum for the accommodations listed on this
site. Payment goes to either the property owner or Accommodation Gateway
for placing a booking.
You may pay money for a booking which may be a % of the total booking
cost to secure your accommodation or full payment in some cases depending
on dates and property terms.
Accommodation Gateway dose not accept full payment. Only a deposit
in some cases where a property owner has requested we do so. The
deposit is then deducted from the full price of the booking which you
then pay to the property owner or accommodaion business where
you will be staying.
Some Property owners request that we take your deposit as payment
for using our booking and reservation engine including for the purposes
of marketing and advertising with us and our system. This deposit
is then deducted from the total price of your booking.
